General Terms and Conditions of Sale
Article 1 - Purpose
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Omegatech SARL, registered under number 001 386 259, (hereinafter referred to as "the Seller") and any individual or legal entity wishing to make a purchase via the website https://black-venom.com (hereinafter referred to as "the Client").
Article 2 - Acceptance of Terms
Any order placed on the website “https://black-venom.com” implies the unconditional acceptance of these GTC. The Client acknowledges having read the GTC prior to validating their order.
Article 3 - Products
The products offered for sale are those listed on the website “https://black-venom.com” on the day the Client consults the site. The products are described and presented with the utmost accuracy. However, if errors or omissions have occurred regarding this presentation, the Seller cannot be held liable.
Article 4 - Prices
The prices of the products are indicated in Euros, including all taxes, unless otherwise stated. The Seller reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the Client.
Article 5 - Order
The Client places an order on the website “https://black-venom.com”. To buy one or more items, they must follow these steps:
- Selection of products and adding to the cart.
- Validation of the cart content.
- Identification on the website or registration on the identification form where they will provide all the requested details.
- Choice of delivery method.
- Choice of payment method and acceptance of the GTC.
- Validation of payment.
Article 6 - Payment
Payment is due immediately upon ordering, including for pre-ordered products. Purchases are paid for by credit card or any other payment method available on the site at the time of the order.
Article 7 - Delivery
Products are delivered to the delivery address provided during the ordering process, within a maximum of 30 days. In case of delivery delay, the Client must instruct the Seller to perform the delivery within an additional reasonable period. If delivery is not performed within this additional period, the Client may terminate the contract.
In cases where the Seller refuses to deliver the product or it is clearly impossible to meet the agreed delivery date, the Client may immediately terminate the contract without going through the additional reasonable period.
In case of contract termination, the Seller will refund the Client all amounts paid, at the latest within fourteen days from the date the contract was terminated.
Article 8 - Right of Withdrawal
In accordance with legal provisions in force, the Client has a period of 14 days from receipt of their products to exercise their right of withdrawal without having to justify reasons or pay penalties. Returns must be made in their original condition and complete (packaging, accessories, instructions...). In this context, the Client's liability is engaged. Any damage suffered by the product on this occasion may be of such a nature as to defeat the right of withdrawal.
Article 9 - Warranty
All products supplied by the Seller benefit from the legal warranty of conformity provided for in articles L.217-4 and following of the Consumer Code or the warranty against hidden defects provided for in articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned, exchanged, or refunded.
Article 10 - Liability
The Seller, in the online sales process, is only bound by an obligation of means. Their liability cannot be engaged for a damage resulting from the use of the internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems.
Article 11 - Intellectual Property
All elements of the website “https://black-venom.com” are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or audio.
Article 12 - Personal Data
The Seller reserves the right to collect personal information and personal data concerning the Client. They are necessary for managing the order, as well as for improving the services and information sent to the Client. They may also be transmitted to companies that contribute to these relationships, such as those responsible for executing services and orders for their management, execution, processing, and payment.
Article 13 - Dispute Resolution
These GTC are subject to European laws. In case of dispute, the parties will strive to find an amicable solution before any judicial action. Failing that, the European courts will have sole jurisdiction.
